These Terms & Conditions ("Terms") govern your access to and use of Awwrt.
Awwrt is operated by Awwrt Systems Pvt. Ltd., registered in Telangana, India.
By creating an account or using Awwrt, you agree to these Terms.
1. About Awwrt
Awwrt provides digital tools for managing artworks and related professional activities.
Features may include artwork inventory, contacts, exhibitions, enquiries, consignments, artwork tracking, sales records, reports, public artwork pages, QR pages, files, and other tools introduced from time to time.
Features available to you may depend on your account type, subscription, device, location, or product version.
2. Eligibility
You must be at least 18 years old to create an Awwrt account.
By creating an account, you confirm that the information you provide is accurate and that you have the legal capacity to agree to these Terms.
If you use Awwrt on behalf of a business, gallery, organisation, or other entity, you confirm that you are authorised to accept these Terms on its behalf.
3. Your Account
You are responsible for:
- Keeping your login credentials secure.
- Information entered through your account.
- Activity carried out through your account.
- Maintaining accurate account information.
- Informing us if you suspect unauthorised access.
You may not intentionally provide false account information, impersonate another person, or access an account you are not authorised to use.
4. Free and Paid Services
Awwrt may offer Free and paid subscription plans.
Features, limits, storage, usage allowances, and other conditions may differ between plans.
We may change plan features, limits, or pricing as the product develops. Material changes affecting an existing paid subscription will be communicated where reasonably appropriate.
5. Payments and Subscriptions
Paid subscriptions are charged according to the price and subscription period shown when you purchase the plan.
Payments may be processed by third-party payment providers.
Unless otherwise stated during purchase, payments are non-refundable.
If you cancel a paid subscription, your paid access will normally continue until the end of the subscription period you have already paid for.
Cancellation prevents the next renewal where automatic renewal applies.
Nothing in this section limits refund or consumer rights that cannot legally be excluded under applicable law.
6. Your Content
You retain ownership of the artwork, images, descriptions, documents, files, and other content you upload to Awwrt.
Awwrt does not acquire ownership of your artwork or intellectual property simply because you use the service.
You grant Awwrt Systems Pvt. Ltd. a limited, non-exclusive licence to host, store, process, reproduce, transmit, and display your content only as reasonably necessary to:
- Operate Awwrt.
- Provide features requested by you.
- Store and synchronise your information.
- Generate reports and documents.
- Display content that you intentionally make public.
- Maintain, secure, and improve the service.
This licence ends when your content is deleted from our systems, except where temporary copies remain in backups or retention is legally required.
7. AI and User Content
Awwrt will not use private artwork, artwork images, documents, or other uploaded user content to train artificial intelligence or machine-learning models without the user's explicit permission.
8. Your Responsibility for Content
You are responsible for content uploaded through your account.
You confirm that you own the content or otherwise have sufficient rights or permission to upload, store, manage, and, where applicable, publicly display it.
You must not knowingly upload content that:
- Infringes another person's copyright or intellectual-property rights.
- Is unlawful or fraudulent.
- Violates another person's privacy.
- Contains malicious software.
- Is intended to interfere with or damage Awwrt or another system.
9. Information About Other People
Awwrt may allow you to maintain information about professional contacts, buyers, collectors, artists, galleries, and other people.
You are responsible for ensuring you have an appropriate lawful basis or permission to collect, enter, and use this information.
Awwrt's own processing of personal information is governed by our Privacy Policy.
10. Public Artwork and QR Pages
Awwrt may allow users to publish artwork information through public pages, QR codes, or shareable links.
Content is not made public through these features unless the user chooses to publish or share it.
When you publish content, you understand that other people may view, share, link to, or otherwise access that information.
You remain responsible for the content you choose to publish.
11. Copyright and Intellectual-Property Complaints
If you believe content available through Awwrt infringes your copyright or other intellectual-property rights, contact info@awwrt.com.
Your notice should provide sufficient information to identify:
- The protected work.
- The content you believe infringes your rights.
- Where that content appears on Awwrt.
- Your contact information.
- The basis of your claim.
We may restrict access to or remove content while reviewing a credible complaint.
Where appropriate, we may contact the account holder responsible for the content.
12. Acceptable Use
You may not use Awwrt to:
- Break applicable laws.
- Commit or facilitate fraud.
- Infringe intellectual-property rights.
- Harass or harm another person.
- Distribute malware or harmful code.
- Attempt unauthorised access to Awwrt or another user's account.
- Circumvent product limits or security controls.
- Scrape or systematically extract information without permission.
- Disrupt or overload the service.
- Reverse engineer protected parts of the service except where applicable law expressly permits it.
- Use Awwrt in a way that creates unreasonable security or operational risks.
13. Third-Party Services
Awwrt may contain links to or integrations with third-party services.
These may include payment providers, WhatsApp, Instagram, YouTube, Google services, Calendly, Tally, Dropbox, or other external services.
These services are operated independently from Awwrt.
Your use of a third-party service may be governed by that provider's own terms and privacy policies. Awwrt Systems Pvt. Ltd. is not responsible for the availability, content, security, or actions of independent third-party services.
14. Service Availability
We take reasonable measures to maintain the availability and reliability of Awwrt.
However, we do not guarantee that Awwrt will always be uninterrupted, error-free, or available.
Temporary interruptions may occur because of:
- Maintenance.
- Software updates.
- Infrastructure failures.
- Internet or network problems.
- Third-party service failures.
- Security incidents.
- Events outside our reasonable control.
Where practical, we will try to minimise disruption.
15. Backups and Important Records
Awwrt provides tools for managing professional artwork information, but users should retain independent copies of important original artwork files, financial records, contracts, certificates, or other critical business information.
Awwrt should not be treated as the sole permanent archive for irreplaceable information.
16. Changes to the Service
We may add, modify, replace, or discontinue features as Awwrt develops.
Where a material change significantly affects a paid service, we will make reasonable efforts to provide appropriate notice.
17. Suspension and Termination
We may suspend or terminate access where reasonably necessary because of:
- Serious or repeated violation of these Terms.
- Fraud or unlawful activity.
- Intellectual-property infringement.
- Security threats.
- Abuse of the service.
- Non-payment.
- Legal or regulatory requirements.
Where reasonable, we will provide notice and an opportunity to resolve the issue before termination.
Immediate action may be taken where necessary to protect users, Awwrt, third parties, or the security of the service.
18. Account Cancellation and Deletion
You may stop using Awwrt or request account deletion.
Account deletion normally begins a 30-day deletion period during which recovery may remain possible.
After that period, account information and user content may be permanently deleted or anonymised, subject to legally required retention and normal backup cycles.
Users should export information they wish to retain before deleting their account.
19. Disclaimer
Awwrt is a software service for organising and managing information.
Unless explicitly stated otherwise, Awwrt does not provide legal, tax, accounting, insurance, valuation, authentication, appraisal, or financial advice.
Information generated or stored through Awwrt should be reviewed by the user where accuracy is important.
20. Limitation of Liability
To the maximum extent permitted by applicable law, Awwrt Systems Pvt. Ltd. will not be responsible for indirect, incidental, special, consequential, or similar losses arising from use of or inability to use the service.
This may include loss of profits, opportunities, business information, or data where permitted by law.
Nothing in these Terms excludes liability that cannot legally be excluded or restricted.
21. Indemnity
To the extent permitted by applicable law, you agree to be responsible for claims arising from your unlawful use of Awwrt, your infringement of another person's rights, or content you upload in violation of these Terms.
22. Changes to These Terms
We may update these Terms as Awwrt changes or legal requirements evolve.
For material changes, we will provide reasonable notice where appropriate.
Continuing to use Awwrt after updated Terms become effective constitutes acceptance of the revised Terms, subject to rights available under applicable law.
23. Governing Law
These Terms are governed by the laws of India.
Subject to mandatory rights available under applicable law, disputes relating to these Terms or Awwrt will be subject to the jurisdiction of the competent courts in Hyderabad, Telangana, India.
